Abstract

This study examines the complex contribution of international law to reducing and dealing with the issue of human rights abuse in modern conflict zones. In a world where asymmetric warfare is increasingly a norm and where
non-state actors are becoming more common, the effectiveness of the global legal framework, which is largely based on International Humanitarian Law (IHL) and International Human Rights Law (IHRL), is under increased examination. This paper reviews the Geneva Conventions and the Rome Statute underlying mechanisms and how the International Criminal Court (ICC) and other United Nations mandates work to hold offenders accountable and prevent atrocities. In a qualitative approach, based on a review of modern legal systems and individual cases, the paper will find a gaping hole in the law in its enforcement whereby normative legal principles have been compromised by the state sovereignty issue, political stalemates in the UN Security Council, and the absence of a centralized mechanism of global enforcement. Moreover, the study examines the so-called complementarity paradigm, which states that the simultaneous use of IHL and IHRL provides the strongest defense of non-combatants, despite the conventional juridical arguments about lex specialist. The results indicate that although international law offers an essential normative framework to determine war crimes and crimes against humanity, its effectiveness depends on the political goodwill of the international community and the empowerment of the domestic judicial processes. The paper ends with a suggestion of a decentralized strategy of accountability, where it is proposed that international human rights standards should be incorporated in the national legislative systems and that the regional human rights courts should be empowered to override global geopolitical deadlocks. This concise overview can be used to highlight the timeless relevance of international legal norms in protecting human dignity in the most turbulent settings of the world.
