Legislative developments review at the start of crim, Crime is impossible, Incomplete offence in the Penal Code of 1352- 1370 and Adaptation to its the Penal Code Approved in 1392

Abstract

For implementing the crime, although appearance of an action or abandonment of material action is always a condition, the punishment of this action is not always subject to a result that a misdemeanant has attempted for taking it. The most important mode of Islamic penalty code 1370 approved against its self, has not had a transparent position versus deficient crimes, in a manner that about beginning of the crime and more about impossible and abortive crimes, was vague and brief, GH. M. A approved 1392 after the excursion of evolutions and much promotion with refer to GH.M. A 1352 to many extent , making clear legal conceptions and the conditions of beginning the crime and impossible crime and considering the crime. In new code of Islamic penalty about beginning the crime, the principle is being crime of it but from 1370 up to now that is during the past 20 years, the principle was that beginning the crime requires legal supported. Abortive crime and impossible crime aren't predicted and Article 122 mentioned code is about beginning the crime. By considering to this material, punishment of abortive crime and impossible crime are conceived to some extent that amount of operation has been conducted, like beginning the crime, is the crime. This article is in the manner of library and descriptive research, we attempted to make clear legal evolutions of beginning the crime, impossible crime and abortive crime in the codes 1352 to 1370 as if we mention the weak and strong points of the rules related to aforementioned crimes and also we compare the survey of this evolutions with ones created in Islamic penalty code 1392
